(45,638 posts)I really with folks who advocate for using the 25th amendment against trump would stop for a minute and think about how the 25th works. Specifically, even if the VP and a majority of the cabinet invoked the 25th, Trump can return to office simply by sending a notification to Congress that he is not "unable to discharge the powers and duties" of the office." Thereafter, the VP and the cabinet have four days to send another notice to Congress declaring that the president is unable to discharge the powers and duties" of the office. It then falls on Congress to determine the issue -- a 2/3 majority vote of both houses is required.
Impeachment on the other hand only requires a majority in the House and conviction requires 2/3 in the Senate.
Finally, Trump may be a whack job, but he is not "unable to discharge the powers and duties of his office" -- he's just doing so in a way a lot of us hate.
