1. Do they automatically get 5 years of back pay, or is it off set by what they may have earned at other jobs?

The court determined that AAA must offer the workers job reinstatement and make each of them whole for any loss of earnings and other benefits. AAA must also compensate each worker for their search for work, interim employment expenses, and for the adverse tax consequences, if any, of receiving one or more lump-sum backpay awards.


For example, say they earned $100k per year at AAA and after being fired, found new jobs paying $90k. Do they get awarded the entire back pay of $500k or would it be the difference, which is $50k? I've often wondered how that worked.
