If someone is that drunk, any sex with her is rape.

A declaration like this would make the entire subject meaningless, IMO. As stated, this would have to include spouses, and cases where the man or both parties are drunk. That is the problem with blanket reactionary statements. They tend to toss actual crimes in with things that are not.
