That every business hiring decision must be accompanied by an e-verified I-9 form. The system is not perfect and will return false negatives as well as positives. If an employee is determined to not have passed the verification it is within the law to ask them for further documentation. Employees who cannot pass further testing can and should be reported to ICE.

Now, what about employers who fail to verify the employee's right to work in the U.S. but fail to report those who do not pass the verification?
First offense: Warning
Second offense: Fines
Third offense: Misdemeanor conviction of the president or CEO for not following the law
Fourth offense: Felony conviction with a minimum 1 year in prison
Fifth offense: Liquidation of the business with the assets going to the government or sale to another party
