.... With subpoenas they can be challenged after being served, but with a search warrant they just show up and start searching. I think that's a feature, not a bug, because it doesn't allow the suspect to destroy or hide evidence. HOWEVER, if it goes to court, you can move to have the evidence thrown out if the warrant was defective.

One thing to remember is that Fulton Co is a special case. Normally, the retention period for election results is 22 months there. Normally, the seized material would have been disposed of long ago, but in this case they were under a court order to preserve it. Other states and counties would not have results laying around to be seized.

It is also the case that secretaries of state are closely cooperating with one another, and if this became a widespread general practice they would all start fighting back.
