Because if he was not, this is even more of a joke.

One might as well go after the mailroom attendant at Goldman Sachs because the company made an illegal trade.

Smith was doing his job. Just as whomever ordered him to do this thing was doing their job.

The only 'political' motivation was to stop a lunatic from being even more dangerous, and that failed anyway...

So, yeah... This should backfire rather spectacularly. We will need to make sure to do our part and always bring it up whenever anyone happens to be around a rethug.
