Federal judge rules Chattah is ineligible as Acting U.S. attorney to prosecute cases

A federal judge Monday granted defense motions to disqualify Nevadas Acting U.S. Attorney Sigal Chattah in three felony cases brought by Chattah after her term as Interim U.S. Attorney expired in July.
Chattah was initially appointed Interim U.S. Attorney by Attorney General Pam Bondi for 120 days. When her term expired at the end of July, Bondi appointed Chattah as Acting U.S. Attorney, a position that could keep her in the post indefinitely.
A provision of the Federal Vacancies Reform Act of 1998 allows the administration to fill a vacancy by appointing the first assistant as acting U.S. Attorney. However, Chattah never held the position of top deputy.
Alternatively, the President may direct either certain senior officials of the agency or any Senate-confirmed official to serve as the acting officer, the act says.
Only two of President Donald Trumps second-term picks for U.S. attorney have been confirmed by the Senate.
In a move designed to prevent Chattah from serving in the acting role, Nevadas Federal Public Defender filed motions to dismiss three indictments brought by Chattah after her term as U.S. attorney expired. In the alternative, the public defender asked the court to disqualify her (Chattah) and the attorneys she supervises.
