The executive branch has no power to set up such a fund. And a so-called "contract" -- whatever the terms -- between a president and the agencies that president controls is absolutely NOT a "settlement" in any way shape or form.

And in fact I can't imagine how the document qualifies as a contract that has any legal force whatsoever. It is a contract to payout money that neither party to the contract has any legal authority over the distribution of.

Perhaps there is some bullshit "legal" argument, but the thing is that the law is not actually all that complex. As far as I'm concerned, however you slice it, this is an attempt to usurp Congressional power in words of an agreement that violates the right of "We the People" to determine how moneys appropriated are spent. The Executive Branch has NO place, except to execute OUR WILL as represented in OUR Laws. The agreement does not qualify.
