If the referendum had failed to pass, it would have just meant that the existing maps would stay the same as they were. That is the exact scenario that occurred when they ruled the referendum violated the Virginia constitution. There would have been no reason for the court to even weigh in in that situation.

That is the reason the court let the referendum proceed in the first place. Had it failed to pass, they wouldn't have had to address the issue at all as it would have been a moot point.
