10. It's a well-written argument for such a quick action - and the court they picked is all Obama appointees

But the court above is the 5th circuit... and more challenging perhaps than that... they don't seem to have a good reason to remove the issue from the court that SCOTUS sent the case back down to. I'm not sure why they wouldn't retain jurisdiction
