Trump and his DOJ may be making the seldom successful criminal defense of vindictive prosecution great again! Along with selective prosecution claims – vindictive prosecution claims are seldom successful, but the Trump administration seems bent on inadvertently changing that legal landscape.
A federal judge seems to agree ordering further discovery and litigation of whether the Trump administration engaged in vindictive prosecution against Kilmar Abrego Garcia – the Maryland man wrongly deported – who since the Trump government was forced to have him returned to the United States is now charged criminally.
