US forces struck another alleged drug trafficking boat in the Caribbean, killing three people, defense secretary Pete Hegseth has said, bringing the death toll from the Trump administrations controversial campaign to at least 70.
The US began carrying out such strikes which some experts say amount to extrajudicial killings even if they target known traffickers in early September, taking aim at vessels in the Caribbean and eastern Pacific.
The US strikes have destroyed at least 18 vessels so far 17 boats and a semi-submersible but Washington has yet to make public any concrete evidence that its targets were smuggling narcotics or posed a threat to the United States.
Hegseth released footage on X of the latest strike, which he said took place in international waters like the previous strikes and targeted a vessel operated by a Designated Terrorist Organization.

(31,424 posts)in the chain of command, down to the seaman that pushed the "fire" button that launches the missile ( or the pilot of the plane that launched the missile ) has some very good lawyers.
"just following orders" didn't cut for the Nazi's at Nuremberg, and it won't cut it for the Navy / Marines / Air Force / Army people doing it now.
We have zero jurisdiction in international waters. There is no declared war. These people, even if they are card carrying members of a drug cartel and have 1000 pounds of cocaine on board ( they aren't and they don't ) can be arrested by the coast guard and any evidence of crimes can be presented in court. Even if found guilty, running drugs is not a federal offense that results in execution.
Drug trafficking is the illegal transporting or transacting of controlled substances. Under federal law, Title 21, Section 841 makes it unlawful for any person to knowingly or intentionally manufacture, distribute, or dispense, or possess with intent to manufacture, distribute, or dispense, a controlled substance.
First Offense: Not less than 5 years, and not more than 40 years. If death or serious injury, not less than 20 years or more than life. Fine of not more than $5 million if an individual, $25 million if not an individual. Second Offense: Not less than 10 years, and not more than life.
Trump can ask the Congress to amend to law to make it a capital offense but even then the people involved are to be arrested, presumed innocent until proven guilty, given competent legal representation and the evidence can be used to convict them by a jury.
What Trump and the entire chain of command is doing is completely illegal and everyone involved will be arrested and either turned over to the international court or tried here in federal court. Murder ( pre-meditated ) is the charge. Life without parole is the punishment. From Trump to Hegseth to the Branch secretary, the Chairman of the joint chiefs, the branch chief, the southern command to the admirals / generals to the commanders / captains... and down to the pilots or seaman that pushed a button... they are all guilty of murder.

Its against this backdrop that The New York Times reported:
A secret Justice Department memo blessing President Trumps boat strikes as lawful hangs on the idea that the United States and its allies are legally in a state of armed conflict with drug cartels, a premise that derives heavily from assertions that the White House itself has put forward, according to people who have read it. ... In reaching that conclusion, the memo contradicts a broad range of critics, who have rejected the idea that there is any armed conflict and have accused Mr. Trump of illegally ordering the military to commit murders.

Whats more, the memos conclusion remains a tough sell. After the White House pitched a related line to Congress in early October, claiming that Trump had determined the U.S. is in armed conflict, Geoffrey Corn, a retired judge advocate general lawyer who was formerly the Armys senior adviser for law-of-war issues, argued that drug cartels are not engaged in hostilities which would mean the White House was crossing a legal line.
This is not stretching the envelope, Corn told the New York Times. This is shredding it. This is tearing it apart.
Nevertheless, theres little to suggest the administration intends to curtail its deadly campaign. On the contrary, Hegseth on Thursday announced something called Operation Southern Spear, which he said will target narco-terrorists and shield our homeland from the drugs that are killing our people.

Firing the militarys most senior legal advisers is an unprecedented and explicit move to install officers who will yield to the presidents interpretation of the law, with the expectation they will be little more than yes men on the most consequential questions of military law.
Hegseth and trump want to convert the military into a force loyal only to trump. It sounds like trump and Hegseth plan to commit acts that a real JAG would block as being an illegal order or unconstitutional
