Judge gives parties in Griffin (R)-Riggs (D) election dispute two more days for final legal arguments

The federal judge overseeing the election dispute over a seat on North Carolina’s Supreme Court is giving parties in the case two more days to submit additional legal arguments. He indicated plans to issue a final ruling in the case after all briefs and arguments are filed.

US Chief District Judge Richard Myers issued an order Wednesday spelling out his plans for resolving the case.

“The court has reviewed the parties’ briefs and identified no issues of material fact,” Myers wrote. “Given the unique circumstances and procedural posture of this consolidated action, the court intends to treat the parties’ briefs as cross-motions for summary judgment and enter summary judgment for one or more parties.”

Summary judgment would amount to a final decision without a trial.
