Former Lt. Gov. Rutherford Leads Lawsuit Over Primary Election Funding

Five politically unaffiliated Maryland voters filed the suit this week, which seeks to stop the state from funding closed primary elections.

Republican attorney Boyd Rutherford, who served as former Governor Larry Hogan’s lieutenant governor, is representing the plaintiffs.

“We are not saying the parties have to allow people who choose not to join their party to selected their leader, but we are saying the state can’t pay for closed partisan primaries because they violate the state constitution,” Rutherford said.

Democratic and Republican primary elections in the state of Maryland are “partially closed,” so to speak.
