Supreme Court allows Trump to end TPS for Haitian, Syrian immigrants

The U.S. Supreme Court has ruled that the Trump administration can proceed with ending temporary protected status for hundreds of thousands of immigrants from Syria and Haiti. In a six to three ruling, the majority of justices found that federal law generally bars judicial review of TPS designation and termination decisions. The court also found that challengers to the law were unlikely to succeed on claims that Haiti's TPS designation was terminated because of racial discrimination.

After the Trump administration ended TPS for nationals of Haiti and Syria last year, the Supreme Court agreed to take an “ordinary review” of the case after lower courts issued temporary injunctions.

TPS was created by Congress in 1990 and is designated when conditions in a country do not allow for its nationals' safe return, and prevents their removal from the United States. Haiti was added to that list after an earthquake in 2010, allowing some of its citizens to live in the U.S. under the program.

However, the Trump administration said it was terminating Haiti’s TPS, citing concerns that “Haitian gangs — such as those designated by the State Department as foreign terrorist organizations — pose a serious threat to U.S. interests.”. Advocates for Haitian and Syrian nationals say that the Trump administration’s termination of TPS was arbitrary and didn’t follow the requirements. They say the government was also discriminatory in removing TPS status from Haitian and Syrian migrants.

Haiti’s security crisis continues to deepen, with at least 2,300 people killed and nearly 100 kidnapped so far this year amid escalating gang violence, according to figures presented by the United Nations on Monday.

The update was delivered by UN High Commissioner for Human Rights Volker Türk during the opening of the 62nd session of the UN Human Rights Council in Geneva, where he called on Haitian authorities to urgently confront entrenched impunity and restore rule of law in the Caribbean nation.

“In Haiti, gang violence has resulted in at least 2,300 deaths, 1,100 injuries and 99 kidnappings since the start of the year,” Türk said, urging faster action to activate judicial mechanisms aimed at addressing the crisis.

Haiti, a nation of roughly 12 million people, has been in turmoil since the 2021 assassination of President Jovenel Moïse, a turning point that accelerated the collapse of state authority in several regions.

Armed gangs now control large portions of Port-au-Prince and have been linked to widespread killings, sexual violence, looting and kidnappings, according to UN assessments.

"Haitian gangs — such as those designated by the State Department as foreign terrorist organizations — pose a serious threat to U.S. interests". They pose a far more serious threat to anyone in Haiti. Which is why they need TPS.

I've been thinking about this off and on all day.

Harming and disenfranchising Blacks... no problem.

Getting Latinos deported... a bit of a problem...
hence the vicious attacks on Dems and a strong
reliance on continuous culture wars.

They are desperate to keep Latinos on side for the
vote (if there is one).

Around this time 10 years ago, when Florida was still seen as a competitive battleground state, Donald Trump campaigned in Miami and spent some time at the Little Haiti Cultural Center, stressing the “common values” he shared with Haitian Americans.

“Whether you vote for me or not,” the candidate said at the time, “I really want to be your biggest champion.”....

And two years after that, a full decade after he stressed the “common values” he shared with Haitian Americans and vowed to be the community’s “biggest champion,” the Republican took steps to eliminate temporary status protection for hundreds of thousands of Haitians currently living legally in the United States.

The move sparked a court fight, culminating in a predictable ruling from the high court’s conservative majority. MS NOW’s Jordan Rubin explained:

The Supreme Court’s Republican-appointed majority sided with the Trump administration over Haitians and Syrians on Thursday in a ruling on the administration’s attempt to end humanitarian safeguards under the Temporary Protected Status program.

Justice Samuel Alito’s majority opinion curbed the power of courts to review government decisions to terminate protections under the TPS program. For this case, the majority said that means Haitians and Syrians aren’t entitled to orders keeping their protections in place while their litigation proceeds, even though lower courts found serious legal problems with the administration’s attempt to end their protections.

Writing for the three-member minority, Justice Elena Kagan explained that without such postponement, “hundreds of thousands of Haitians and Syrians living in this country will lose their legal status and work authorization” and that most of them “will have no legal option except to leave the country, even at the price of leaving family behind.”

Kagan went on to note that hundreds of thousands of lives “will be uprooted, most permanently, while this litigation to annul the Secretary’s (likely illegal) termination orders proceeds.”

By all appearances, the White House considers such consequences a feature, not a bug.

In her latest opinion piece for The New York Times, Kate Shaw, a professor at the University of Pennsylvania Carey Law School, added that with the high court’s ruling, the administration “is now free to move forward with what immigrants rights advocates describe as the largest de-documentation in U.S. history.”

When white South African refugees enter the United States in the coming weeks, they reportedly can expect a special treat: a gift bag containing an Android tablet, copies of the Constitution and Declaration of Independence, and an American flag. Oh, and one more perk: literature that argues white people in South Africa and the U.S. are victims of discrimination — and that the U.S. Civil Rights Movement was misguided.

That’s the plan that’s being finalized in the Trump administration, according to a new story from The New York Times, which cites government documents and an official familiar with the matter, and observes that welcome gifts of this kind are “unusual.” These welcome bags are a brazen expression of white nationalism. And remarkably, they represent the White House doing exactly what MAGA conspiracy theorists love to (ludicrously) accuse the left of trying to do: Use immigration policy to boost its political fortunes.

According to the Times, the bags are expected to include a letter that reads, “The Trump administration understands America’s immigration system must put the U.S. citizen first, and only welcome in those who will assimilate into the American way of life and preserve our borders, language, culture, traditions and ideals.”

The president and his administration have long made it clear that Afrikaners are virtually the only people who fit the White House’s criteria. At a Turning Point USA event in April, Trump boasted, “We suspended all refugee resettlement — except for persecuted South Africans.” And Trump has said that the people in South Africa being “persecuted” are Afrikaners — basing his claim on white nationalist disinformation that a “white genocide” is being perpetrated in South Africa.

Singling out this population, amid all the people enduring wars and serious persecution around the world, was in and of itself a white nationalist salvo. But the letter, combined with other texts and booklets planned for the bag, take it to another level.
