IRS Agents to Review OnlyFans Content to Determine if It's 'Pornographic'

Some IRS agents wont have to worry about getting in trouble for watching porn at work, because part of their job duties will literally involve reviewing content on OnlyFans and other online creators.
The issue, according to a report by Andrew Duehren at The New York Times, is the interpretation of a restriction on the no tax on tips deduction passed as part of the One Big Beautiful Bill Act that says that tips earned for prostitution or pornographic activity are not eligible.
The legislation didnt offer much additional guidance, and the IRS has yet to issue any statements clarifying what exactly constitutes pornographic activity, leaving the taxing agency in a similar boat as Supreme Court Justice Potter Stewart when he endeavored to define obscenity in the 1964 case of Jacobellis v. Ohio: I know it when I see it. And apparently, the IRS expects its agents to know it when they see it as far as determining eligibility for this deduction.
There are almost five million creator accounts on OnlyFans, reported the Times, but its not clear how many of them are Americans and subject to U.S. tax laws, and not all of them are posting pornographic or sexual content. Its also unclear, wrote Duehren, whether strippers could claim the tips deduction, because [t]here is plenty of activity that an accountant or tax lawyer could argue is merely titillating.

(39,732 posts)My impression has always been that women are the creators and consumers of the "romance" genre fiction. However men (mostly) are the creators and consumers of the raunchier stuff that most of us label as "porn."
Yes I know ... there are many exceptions ... but I'm talking in general terms only.

(10,769 posts)Some OF creators offer a "free" subscription option where teasers are posted. Those teasers can be pretty racy. The end game though is to earn money and these OF creators who do a "free" option ultimately want you to sign up for a "VIP subscription" where you pay a fee, the content is more personal. And possibly more explicit. That's my experience with spicy content creators.
