Prosecutors to immediately provide 'all' Comey grand jury materials for judge's secret review

Days after the Trump administration asked a federal judge to rein in a magistrate's order on discovery of grand jury materials, the DOJ's obstruction and false statement case against former FBI Director James Comey returned to court. The status conference, which lasted under 10 minutes, ended with the DOJ pledging to hand over grand jury transcripts and audio to the court, so the judge can review it "all" and decide if the defense can, in fact, get its hands on those materials.

U.S. Magistrate Judge William Fitzpatrick kicked off the brisk 4 p.m. hearing on Monday by stating that it "seems to make sense to me" that the grand jury materials Comey's team seeks are reviewed in private, out of view of the defense and the public.

Fitzpatrick made waves at a hearing last Wednesday, dressing down the government for an "indict first investigate later" attitude and ordering the DOJ to hand over late September grand jury transcripts and audio, among years-old "Arctic Haze" leak probe evidence, to the defense the next day.

On Thursday, the DOJ's Tyler Lemons, Gabriel Diaz, and interim U.S. Attorney Lindsey Halligan instead raised a swift appeal to U.S. District Judge Michael Nachmanoff on the issue, asking the jurist to find Fitzpatrick's order "exceed[ed] the scope of" his "delegated authority[.]"
