A Texas federal judge had scathing words for the Trump administration last month when he dismissed a largely fictional case against a Honduran immigrant who officials accused of harming an Immigration and Customs Enforcement agent who broke the mans car window during a stop. The Governments conduct wasand has beenoutrageous, U.S. District Judge Xavier Rodriguez, a George W. Bush appointee, wrote in his October 20 ruling tossing the case.
The controversy centered around a June stop in San Antonio, where federal agents and Texas troopers arrested Jaime Alberto Quintanilla-Chavez, 35, a Honduran immigrant married to a U.S. citizen. After getting a tip from a Texas woman who claimed Quintanilla-Chavez was in the country illegally and had abused her daughter, officers considered the man an easy target and prepared to arrest him.
During the stop, agents ordered him to open the doors of his truck and soon broke the drivers-side window. In the process, a Homeland Security Investigations officer, William Carl, suffered a cut to his arm. Federal officials accused Quintanilla-Chavez of impeding officers and harming the agent, seeking a sentence of up to 20 years.
In his ruling, Judge Rodriguez called the governments description of the stop largely fictional, pointing to a variety of issues with the stop: agents lacked a warrant; there was no evidence the Honduran had an order of removal from the country; and officers only asked about his immigration status after they forcibly removed him from the truck and handcuffed him.

(5,420 posts)The coward "informant" likely had one or more angles. Like their partner is seeking that poor guy's position at a workplace, or a rivalry with the man's wife. And the true crime is ICE or DHS never took it to a judge to get an actual warrant.

(768 posts)Although I have to admit, I kind of saw this coming, beginning in the '80s and '90s, and especially after GWB stole the 2000 election and rammed through his unAmerican "Patriot" Act.

(768 posts)in 1966, one year after the Civil War Centennial ended. It made me hate my former slave state of Arkansas, even though it hadn't been a slave state in 100+ years. Arkansas finally came to terms with its past in the late '60s, and the state's Democratic Party began to distance itself from that in the '70s with New Democrats such as Dale Bumpers, David Pryor, and even Bill Clinton.

(768 posts)That was in 1970, when he was running against then-Governor Winthrop Rockefeller. Even though Rockefeller was a Republican, he was a progressive in the style of Robert LaFollette. So, it was kind of a win-win situation. Bumpers won, then 4 years later he challenged the esteemed J. William Fulbright in the Democratic primary for the US Senate, and won. He went on to become a very admired US Senator.
I met him once, at a Jefferson-Jackson Day picnic in Little Flock (a small community in Benton County), and was really impressed with the man. He served Arkansas well.

And since you mention a Rockefeller Senator - the other liberal one was Jay Rockefeller in WV, who is sorely missed!

(1,909 posts)We have had problems with some part of the 'Thin Blue Line' lying for some time.
But anyone in this administration is just going to spout whatever bullshit they want, facts be damned.
And they are trying to prosecute James Comey for lying in a mishmash question in a senate hearing?
We now know the Statue of limitations is 5 years. These morons should remember that.
