Former A.G. Eric Holder Urges Democrats to Reform 'Broken' Supreme Court Once Back in Power

Source: MEDIAite

Former U.S. Attorney General Eric Holder called on Democrats to reform the Supreme Court should they win a “trifecta in 2028” on Monday, calling it “a broken institution” that was causing “an untold amount of damage to the fabric” of the country.

“If you look at what’s happening at the district court level, at the court of appeals level, it doesn’t matter who the president was who appointed the judge. The judges have ruled, I think, courageously and correctly,” said Holder during an interview with liberal media company Meidas Touch. “It’s only when you get to the Supreme Court that you see these problems start to arise.” He continued:

And it’s the use of, this overuse of the shadow docket. You know, by taking these cases and decided them, essentially deciding them, without hearing any oral argument, with any adequate briefing. You know, deciding these really important matters in that way challenges the legitimacy of the court and does an untold amount of damage to the fabric, legal fabric of this nation.

I think the reality is, and it pains me to say this, I think the Supreme Court is a broken institution and it’s something that has to be, I think, a part of the national conversation in ’26 and in ’28. What are we gonna do about the Supreme Court? And I think that we have to think about, again, talking about the acquisition, the use of power, if there is a Democratic trifecta in 2028, and I think the possibility of that is pretty good.

"Reforming" the Supreme Court should be a Democratic campaign promise in 2028. sop Nov 4 #2
I don't know how you do that without appointing new judges on the court. everyonematters Nov 4 #3

Fetterman votes 90% of the time with Democrats. His is not going to vote against a Dem nominee. everyonematters Nov 4 #7

I recall pointing out to the "yeah, but Hillary's emails" crowd back in 2016 what it would mean if Trump had the chance to appoint several Supreme Court justices.

You don’t, that’s why it is imperative that the Senate goes Democrats and we have democrats that care about justice, not blue dog dems that are there to pad their wallets, stock market gains and free healthcare. The senate needs to be at least 53 democrats, because with Fetterman, you lose a vote. Sinema and Manchin were our losing votes with Joe Biden term. Once the senate is back in dem control, President (democrat) can then add justices to the court

for removal of several of these corrupt judges. Alito and Thomas for corruption. Some of the others for lying to Congress. Get rid of them.

Why can't Democrats just come out and say things without diluting all meeaning and impact?

Translation: If we ever expect to have the power to make the changes he tepidly hints at in the ever-so gentle way, we must SELL THIS IDEA to the public by making it prominent in our campaigns.

People don't want a freaking "national conversation", damn it. They want bold leaders with bold plans and a party that will come together around these action-oriented plans. There is one such plan floating around that has these strong points:

• Overturn Citizens United
• No personal use of PAC money, even after retiring
• Codify Women's Right to Choose
Term Limits and highest code of ethics for SCOTUS
• Get Rid of the Electoral College
• Outlaw Gerrymandering Nationwide
• Return Fairness Doctrine in Media
• Universal Healthcare for ALL
• Ban Stock Trading While in Congress
• 5 year wait before taking jobs in industries overseen/regulated when in office
• Cap Congress Salary at 1.5x Median Income of Their District
• Tax Billionaires Out of Existence
• Tax Unrealized Gains Used as Loan Collateral
• Tax Mega-Churches involved in political activity
• Raise Federal Minimum Wage to $20/hr
• Eliminate the Presidential pardon privilege
Not a "national conversation" It is a RECOVERY PLAN for the nation.

When he was a candidate for President in 2016 he proposed the following:

1. Expand the court to 15 justices
2. Reserve 5 seats each for Democrats and Republicans to fill
3. Reserve 5 seats for the other 10 justices to agree upon and nominate

I would add that any nominee be required to have a straight up or down vote within 30 days of the nomination being conveyed to the Senate. If the Senate fails to hold that vote then they would each have their paychecks docked one months pay for each month or part that they fail to hold that vote.

This would bring SCOTUS as close to an ideologically balanced court as humanly possible.

Obviously, this would require a Constitutional amendment since the power to nominate justices is reserved for the President
