Judge Won't Immediately Block Trump Troop Deployment to Illinois

Source: Bloomberg Law News

Oct. 6, 2025, 4:09 PM EDT

A federal judge declined to quickly issue a temporary order blocking the Trump administration's plan to deploy National Guard members to Chicago to counter protests against the US immigration crackdown, while urging the government to delay the controversial plan until she rules.

US District Judge April Perry on Monday said she could not rule immediately on a request by the state of Illinois for a temporary order that would block for at least two weeks the deployment of federalized National Guard troops from Illinois and Texas. She set a hearing for Thursday for arguments on the request.

Perry, an appointee of former President Joe Biden, said she was "troubled" by the administration's lack of clarity about where exactly the troops would be mobilizing and what they would be doing. But she said she needed to give the government time to review the filings and respond in writing before she issues a decision in the case, which was filed earlier in the day.

"In the meantime, we'll wait," the judge said. "If I were the government, I would strongly consider taking a pause on this until Thursday, so we are not in a position where we're doing a full-fledged hearing with whatever has happened."

1. It doesn't matter. The judge on the Portland case blocked ALL deployments

Because Trump circumvented her ruling

Which order do they have to follow? The one where the “judge on the Portland cased blocked ALL Deployments”
Or the one listed in this article saying the judge will not block Trump troop deployment until the judge can review all the facts.

Each order must be obeyed. Since one is more strict, he must obey the most strict order.

6. This Biden judge is following the law, giving the defendants time to justify themselves. Which they can't and won't.

The 7th Circuit (under Amy Coney Barrett) is not the same as the 9th Circuit (under Kagan)

These states have to stand up to maga SCOTUS scrutiny and these judges know it.

9. True. But remember that civil warmonger Abbott said he'll send his to IL. But as you say, not yet.

10. Many of the earliest suits against 45 back in February and March for all kinds of illegalities, had been thrown out

because the "threats" of doing something, "hadn't happened yet", and thus the issues were "not an 'emergency'" requiring an immediate TRO. The "threats" DID eventually happen however, and the parties refiled.

In this IL case, it looks like there is a hearing scheduled for Thursday to review.

11. Yes. I hope the judge also keeps the general NG 'landscape' in mind as she hears the defense.

Judge in Illinois case on National Guard: "If I were the government, I would strongly consider taking a pause on this until Thursday."

The court "declined to quickly issue a temporary order ... while urging the government to delay the controversial plan until she rules."

15. There used to be a concept called presumption of regularity that the trump DOJ has thrown away

Judges are having to be very careful in their orders

Judges are having to write orders to combat DOJ gamesmanship b/c the presumption of regularity is toast, i.e.: Judge Xinis: "Is my oral order sufficient or do you need it in writing now?" or last night when DoJ circumvented a TRO on semantics. We discuss: www.muellershewrote.com/p/new-judge-...
