President Donald Trump is expected to fire U.S. Attorney Erik Siebert after Sieberts office was unable to find sufficient evidence that New York Attorney General Letitia James committed mortgage fraud, ABC News reported on Thursday night.
Trump has feuded with James after the attorney general successfully sued the Trump Organization for fraud. Judge Arthur Engoron ruled against Trump, concluding that the former president and his company deceived banks, insurers, and others by massively overvaluing his assets and exaggerating his net worth on paperwork used in making deals and securing financing. The Trump Organization was ordered to pay $354 million, a figure that increased to north of $500 million with interest this year. Last month, however, a New York appeals court ruled the amount excessive and threw it out.
The president has reportedly been leaning on federal prosecutors to bring charges against James for alleged mortgage fraud. She has been accused of falsely claiming her house in Virginia as her primary residence despite being legally required to live in New York as an elected official there.
ABC News reported on Wednesday that Siebert, who is the U.S. Attorney for the Eastern District of Virginia, was having difficulty finding enough evidence to sustain a conviction against James. On Thursday, the outlet said Trump is expected to fire the prosecutor.

(7,417 posts)It's obvious the US system of justice is no longer balanced. Maybe it never was and we just didn't have a convicted felon as president with a corrupt supreme court to abuse it. Either way, it needs to be changed.

But it goes back to at least Raygun (I won't count Nixon firing a "top prosecutor", but we know his obnoxious behavior has been a template that 45 has been following, almost every step of the way ).

WASHINGTON Three weeks ago, Justice Department officials settled on a talking point to rebut the chorus of Democratic accusations that the Bush administration had wrongly injected politics into law enforcement when it dismissed eight U.S. attorneys. Why not focus on the Clinton administrations having fired all 93 U.S. attorneys when Janet Reno became attorney general in March 1993? The idea was introduced in a memo from a Justice Department spokeswoman.
The message has been effective. Whats followed has been a surge of complaints on blogs and talk radio that it was the Clinton administration that first politicized the Justice Department. The facts, it turns out, are more complicated.

On the issue of Clinton [U.S. attorneys], we called each one and had them give us a timeframe. Most were gone by late April. In contrast, Clinton [Justice Department] told all but a dozen in early March to be gone immediately, McNulty said. The difference appears minor. Both McNulty and Sampson acknowledged that the Bush administration, like the Clinton administration, brought in a new slate of U.S. attorneys within a few months of taking office.
But historical data compiled by the Senate show the pattern going back to President Reagan. Reagan replaced 89 of the 93 U.S. attorneys in his first two years in office. President Clinton had 89 new U.S. attorneys in his first two years, and President Bush had 88 new U.S. attorneys in his first two years. In a similar vein, the Justice Department recently supplied Congress with a district-by-district listing of U.S. attorneys who served prior to the Bush administration.

That's why you heard references to the term "Saturday Night Massacre" attributed to what 45 has been doing.
Nixon's impoundment of funding for stuff that he didn't like, is also something that lead to the law that 45 is breaking right now. 2 peas in a pod!

where the last action is "Placed on Senate Executive Calendar. Calendar No. 390." on Sept 11. So that looks like he isn't actually the US Attorney yet. Which presumably makes it easy to fire him - just withdraw the nomination.
But doesn't that mean the US government has been lying since January? Shocking, with this crew's reputation for probity, I know ...

People "nominated, awaiting confirmation" and their "Acting" positions expired, judges in that jurisdiction either extended them or not, and if not, he manufactured some other position for them and unilaterally declared them "the U.S. Attorney".

Pursuant to 28 U.S.C. § 546(c), Erik S. Sieberts current 120-day term as the Attorney General-appointed Interim U.S. Attorney for the Eastern District of Virginia expires on May 20, 2025. The District Judges of our Court today unanimously appointed Mr. Siebert to continue in his role as Interim U.S. Attorney, pursuant to 28 U.S.C. § 546(d), effective May 21, 2025.

But for others, that's why you are seeing lawsuits filed by defendants in those districts with "fake" U.S. Attorneys and demanding any prosecutions under them, be vacated.
