Trump's LA Troop Deployment Violated Federal Law, Judge Rules

A US judge ruled President Donald Trumps deployment of National Guard troops to Los Angeles during protests against his immigration crackdown violated federal law.
US District Judge Charles Breyer on Tuesday issued an order barring barring the use of troops deployed in California and any other military troops in the state to execute the laws. But he paused his ruling pending further legal action.
There were indeed protests in Los Angeles, and some individuals engaged in violence, Breyer wrote. Yet there was no rebellion, nor was civilian law enforcement unable to respond to the protests and enforce the law.

Firefox has what they call a "Reader Mode" (with a little "paper" icon at the end of the URL line) that will often let you read the articles, but stripped of their style sheets.

The evidence at trial established that Defendants systematically used armed soldiers (whose identity was often obscured by protective armor) and military vehicles to set up protective perimeters and traffic blockades, engage in crowd control, and otherwise demonstrate a military presence in and around Los Angeles. In short, Defendants violated the Posse Comitatus Act, Breyer wrote in a 52-page opinion.

The stay of this ruling is until next week for L.A.
The D.C. deployment is a different animal that they have been trying to use to obfuscate what is "lawful" OUTSIDE OF that special circumstance, and justify going to other cities.

(2,560 posts)Is the slow reaction time of the legal system. He does something illegal, so, to stop that, he has to be sued. And weeks pass from initiating the suit to the final ruling. Even years, if Trump abuses again, the appeals process. And by the time that has passed, the damage is done..
It's a game he plays over and over. He know she will never suffer full penalties because he can delay, appeal, delay again, appeal again, until The original charge has ossified.
Whet needs to happen is to declare Trump a vexatious litigant - one who abuses the legal system..

U.S. District Judge Charles Breyer issued an order prohibiting troops from engaging in security patrols, riot control, arrests, searches and crowd control. The order does not take effect until Sept. 12 to allow the Trump administration to appeal.
Breyer said the use of federal troops effectively created a "national police force with the president as its chief" and violated the Posse Comitatus Act.
"The evidence at trial established that Defendants systematically used armed soldiers (whose identity was often obscured by protective armor) and military vehicles to set up protective perimeters and traffic blockades, engage in crowd control, and otherwise demonstrate a military presence in and around Los Angeles. In short, Defendants violated the Posse Comitatus Act," Breyer wrote.....
Breyer issued his decision after holding a three-day trial last month featuring testimony from military leadership about the ongoing operations in the Los Angeles area.

His analysis in a 52-page ruling led him to issue an injunction barring the government from:
deploying, ordering, instructing, training, or using the National Guard currently deployed in California, and any military troops heretofore deployed in California, to execute the laws, including but not limited to engaging in arrests, apprehensions, searches, seizures, security patrols, traffic control, crowd control, riot control, evidence collection, interrogation, or acting as informants, unless and until [government] Defendants satisfy the requirements of a valid constitutional or statutory exception, as defined herein, to the Posse Comitatus Act.
Breyer noted that his injunction only applies in California, not nationally, and that the government doesnt have to withdraw the 300 guard troops currently stationed in L.A., nor is it barred from using troops consistent with federal law. The judge also said his injunction wont take effect until noon Friday, Sept. 12, which gives the administration time to appeal.
In related litigation, a federal appeals court panel previously lifted a temporary restraining order that Breyer had issued against the deployment itself.
