Court revives posthumous bias suit vs. BNSF for female workers

A former female train conductor's civil rights lawsuit can go forward against BNSF Railway Company on her behalf posthumously and on behalf of other women in similar positions at the Alliance railyard.

The Eighth Circuit Court of Appeals' decision on Thursday brought new life to the case, which a federal district judge in Nebraska last year said should be dismissed.

In 2021, the U.S. Equal Employment Opportunity Commission brought the case against BNSF Railway Company alleging that Rena Merker faced a barrage of sexual harassment on a near daily basis while working at the railyard in western Nebraska.

She ultimately left her job and died in January 2024.

I am not surprised. I faced backlash just for being on the job. I also knew another female who was ridiculed for saying something about sexual harassment and she ended up quitting.
