Governor of deep red state sues Trump after 'whim' leaves residents reeling

TOPEKA Kansas Gov. Laura Kelly joined 22 other states and Washington, D.C., in suing the Trump administration for terminating federal funding, which she said has led to cuts to state agriculture, health and safety programs on a whim.
The federal lawsuit, initially filed in June in Massachusetts, targets decisions from President Donald Trump and the Department of Government Efficiency that are rooted in a regulation allowing the administration to eliminate funding if it no longer effectuates the program goals or agency priorities.
Kelly said in a news release that the decisions have made no sense. I joined this lawsuit on behalf of Kansas to ensure funds going towards critical programs our state depends on are not ripped away by the Trump administration or any presidential administration on a whim, she said.
Kelly joined the lawsuit in an amended complaint filed July 31.

I know her a bit, through her kids and her husband and I have done some door to door work for her. I admire how she works.

(2,958 posts)Handicapped by her GOP legislature, and a surprisingly large percentage of voters who are nostalgic for Brownback. This is one of the reasons that I moved back to Tucson from Atchison KS.

I hope Arizona is better for you. I was born here and am rooted to a farm I bought so I am here to stay. I do not know Atchison well so I cannot say much about it.
I see that Vicki Schmidt is thinking of running for governor. Should be an interesting run, I know her well and I like her very much and I know she is not a hard R but...

(126 posts)The traitor party controls the legislature but she does what she can to minimize the crazies. She's also the chair of the Democratic Governors Association. I'm hoping she can get SNAP and LIEAP benefits restored since tens thousands of Kansas rely on those programs. I'm not real hopeful but we have to keep trying.

(2,752 posts)For almost two terms, and she has done the best she can. However, there are too damn many repukes in the legislature and they block almost everything she tries to accomplish. I hate those evil, greedy bastards.

(6,557 posts)she does the best she can, given the legislature allied against her. It's not only repukes against her, it's "Brownback" repugs who are working against her every day of the year. There are things she's done I'm not crazy about, that seemed to lead too far to the right, but given her situation, I think she's done more FOR Kansans than against them, ala repug laws and policies. I've voted for her twice, and if she runs again, I'll vote for her again. I honestly can't say whether or not she's term limited... I actually haven't looked that up. I've been satisfied enough with her to not feel the need to "look forward" to the day she's kicked out of the chair... so different than when brownback held the governorship.
That's being generous. We're not even talking about a whim here - just NOTHING. Like no reason at all, period.
That's pretty much the MO of all that has been happening with the Trump misadministration.

(676 posts)Good for the dem governor for fighting for them. Its not like any other elected reps in the state will (at least at the federal level, I see only Sharice Davids as a Dem elected rep, other 3 reps are republican, as are the two senators).

That law is very specific on identifying clearly and specifically how the funding was not effectuated.
I seriously doubt pedo Trump did that. Even his minions aren't able to follow written laws....hell the MAGA idiots on the Supremes can't even follow the US Constitution.
It's in the regulation commonly called Title 2. It's long but here is a piece of it:
200.340 Termination.
(a) The Federal award may be terminated in part or its entirety as follows:
(4) By the Federal agency or pass-through entity pursuant to the terms and conditions of the Federal award, including, to the extent authorized by law, if an award no longer effectuates the program goals or agency priorities.
(b) The Federal agency or pass-through entity must clearly and unambiguously specify all termination provisions in the terms and conditions of the Federal award.
(c) When the Federal agency terminates the Federal award prior to the end of the period of performance due to the recipient's material failure to comply with the terms and conditions of the Federal award, the Federal agency must report the termination in SAM.gov. A Federal agency must use the Contractor Performance Assessment Reporting System (CPARS) to enter information in SAM.gov.
(1) The information required under paragraph (c) of this section is not to be reported in SAM.gov until the recipient has either:
(i) Exhausted its opportunities to object or challenge the decision (see § 200.342); or
(ii) Has not, within 30 calendar days after being notified of the termination, informed the Federal agency that it intends to appeal the decision to terminate.
(2) If a Federal agency, after entering information about a termination in SAM.gov, subsequently:
(i) Learns that any of that information is erroneous, the Federal agency must correct the information in the system within three business days;"
I doubt pedo Trump did any of this, let alone what further is required to terminate a government award/funding that I Didn't post here.
