The White House threatens sanctuary cities in another EO, but courts are skeptical

Source: NPR

Updated April 28, 2025 7:29 PM ET

WASHINGTON — President Donald Trump signed an executive order on Monday aimed at identifying sanctuary cities, part of a broader effort to target jurisdictions that limit their cooperation with immigration authorities.

The executive order directs the Departments of Justice and Homeland Security to identify jurisdictions where local enforcement has declined to cooperate with the Trump administration's immigration crackdown.

"It's quite simple," said White House press secretary Karoline Leavitt during a press briefing on Monday morning. "Obey the law, respect the law, and don't obstruct federal immigration officials and law enforcement officials when they are simply trying to remove public safety threats from our nation's communities."

The executive order could set the stage for more federal lawsuits against cities, states and counties that don't fully cooperate with U.S. Immigration and Customs Enforcement. Those sanctuary jurisdictions argue that collaborating with ICE would drain their resources, and undermine trust between police and immigrant communities.

U.S. District Judge William H. Orrick said a presidential executive order violates the Constitution’s separation-of-powers principles and spending clause.

https://www.washingtonpost.com/politics/2025/04/24/federal-judge-blocks-trump-withholding-funds-sanctuary-cities/

A federal judge on Tuesday blocked the Trump administration from pulling federal funds from San Francisco, Santa Clara County, and 14 other cities and counties it deems “sanctuary jurisdictions,” handing another legal blow to President Donald Trump’s crackdown on immigration.

U.S. District Judge William H. Orrick of the Northern District of California granted the preliminary injunction and in his order cited a similar executive action from the Trump administration in 2017 — which Orrick also presided over and blocked — that attempted to halt funds and was found to be unconstitutional nationwide.

Orrick referred to precedent in that ruling and in his order said again that such spending powers are constitutionally vested in Congress. He said attempts by the president to place conditions on federal funds violate the separation of powers.

The administration is restrained and enjoined “from directly or indirectly taking any action to withhold, freeze, or condition federal funds from the Cities and Counties,” Orrick wrote, mandating that the Trump administration “provide written notice of this Order to all federal departments and agencies” by Monday......

In siding with the plaintiffs, Orrick also agreed that the “threat to withhold funding causes them irreparable injury in the form of budgetary uncertainty, deprivation of constitutional rights, and undermining trust between the Cities and Counties and the communities they serve.”

This list is really meaningless

They’re preparing to roll over or kick the case to another court that will either roll over or kick the case to the Supreme Court that will roll over.

They could have put some real border security actions into affect while Kamala was boarder czar, instead of a failed ploy to make the republicans vote against a border bill, then let her take that and run with it…, then we wouldn’t have a nazi deportation crackdown like we have now 😔

Not that it matters, but I’ve voted democrat every election since the 70’s. It’s easy to post a bunch of crap about the disastrous mess our country is in now. It’s a little harder to look in the mirror and ask yourself how we got here.

Biden had been, to date, deporting more than 45 has and with few coming to the border now, and with "border" (in quotes) having been a ridiculous DECADES LONG GOP "talking point", producing many yearly photo-op stunts, these facts have forced them to resort to rounding up people who are either citizens or have been going through the process.

I did try this posting stuff previously, and I’m definitely not right wing, but i had to move on, and I guess I probably will again.

I truly believe the Democratic Party can stand for justice and equality in this country AND take on the issues they really don’t want to talk about. But you hate be able to communicate with the all voters who have been brainwashed for years.
