FBI director posts photo of arrested Wisconsin judge's perp walk, possibly violating DOJ policy

CNN FBI Director Kash Patel posted a photo on X Friday night of the Wisconsin judge who was arrested for allegedly obstructing immigration agents while she was handcuffed, being escorted to a vehicle by officials.
The photo of Milwaukee County Circuit Judge Hannah Dugan does not show her face, but shows her being escorted by three law enforcement agents in a perp walk. The caption by Patel read, No one is above the law.
According to the Confidentiality and Media Contacts Policy listed on the Justice Departments website, DOJ personnel should not voluntarily disclose a photograph of a defendant unless it serves a law enforcement function or unless the photograph is already part of the public record in the case.
Former Attorney General Eric Holder, who implemented the policy during the Obama administration, worked during his tenure to make it more difficult for members of the media to obtain photos of defendants, such as mug shots. Holder told CNN that Patels social media post violates this policy.

once Trump is gone, and he will be, there wont be anyone to pardon them.

(920 posts)I think arresting a judge for no lawful reason is a much bigger violation of DOJ policy than posting a picture of a perp walk. The Trump Fascist Regime does not care for norms, policies, or laws. They are fascist criminals and will get away with everything that they can.

"Dugan was first elected to a six-year term on the Milwaukee County Circuit Court in 2016 and reelected in 2022. She has a decadeslong history of working with aid organizations and was an active member or leader of several Milwaukee-area legal groups and charities. Much of her experience appears to focus on advocacy for the poor.
Prior to her election, Dugan practiced civil law for six years, according to her LinkedIn. She previously served as executive director of Catholic Charities of Southeastern Wisconsin and was a past president of the Milwaukee Bar Association. She also worked as an adjunct assistant professor at Marquette Universitys law school. Her LinkedIn describes her as having been a frequent speaker on ethics and poverty law topics.
In 2003, she was named by the Roman Catholic Archbishop of Milwaukee to a board that assessed complaints of sexual abuse against members of clergy, according to media reports at the time.
She wrote often about civil rights and the law as a contributor to the Milwaukee Independent. Her campaigns Facebook page shows her participating in a variety of local community events marching in parades, planting American flags at a veterans cemetery and judging poetry competitions."

I am a corporate lawyer but I do know basic federal criminal procedure. Judge Dugan was arrested on a magistrate warrant and the case had NOT been presented to a grand jury. Before this case can go to trial, this case has to be presented to and voted on by a grand jury. The arrest on Friday was a stunt to "whip the MAGA faithful into a frenzy." One can arrest a suspect without a grand jury indictment but normally there has to be good reason for such arrest

Additionally, Dugan was arrested pursuant to a criminal complaint signed by a federal magistrate judge. Theres nothing improper about that as such, but for felonies in federal court, prosecutors must convene a grand jury and present evidence. Only if the grand jury returns an indictment can someone be prosecuted.
Going before a grand jury isnt a nicety or a minor procedural step. The Fifth Amendment requires it. Arresting Dugan before convening a grand jury was intended to get flashy headlines and whip the MAGA faithful into a frenzy. Even if a grand jury declines to indict Dugan, the administration has succeeded in creating a climate of fear and suspicion.
Recall that although Trump faced 88 charges in four criminal cases for much worse things than what Dugan is accused of, he was always charged by indictment after presentation to a grand jury and allowed to turn himself in. Here he is in Georgia, where he faced 13 felony counts for trying to overturn the 202 election. Here he is in New York, where he faced and was convicted of 34 felonies related to falsifying business records to hide his hush payments to Stormy Daniels. New York state was so solicitous of Trump that he didnt even have to have his mug shot taken. When he voluntarily surrendered in Miami for the classified documents case, he wasnt handcuffed.,,,,,
It will be interesting to see a grand jury would indict this judge on the actual facts
As much as the administration would like it to be otherwise, those administrative warrants arent the same as judicial warrants. Judicial warrants are signed by a federal or state judge or magistrate and must be complied with as long as they are valid. Administrative warrants also known as immigration warrants are issued by administrative agencies such as ICE and signed by an immigration judge. Despite also being called judges, immigration judges are not part of the judicial branch. They are appointed by the attorney general and are part of the executive branch.
I wonder if this case will ever be presented to a grand jury,
