I can’t imagine that would be an acceptable excuse. I double the defense attorney would posit that as a defense. And prosecution will point out the training and UCMJ that says you don’t follow illegal orders.

One thing I wish we would publicize more is that criminal trials will be held for all those who commit crimes under the Felon’s orders. The commanding officers that launched the attacks on those fishing boats should be first to trial
