If not, can they resign and not be forced to follow illegal orders or be tried for 'treason'? Anybody currently considering a career in the military has to be rethinking that option. Being a future victim of civilian policy whims doesn't sound very wise at present.

This 'government power by fiat and presidential tantrum' has to have some legal limits?

Can a retired officer be recalled to active duty for the sole purpose of a military prosecution? I thought they could only be recalled in a war or emergency.

they can be recalled to active duty for the purpose of prosecution, but in this case, there is no violation of any articles of the UCMJ, he didn't say to disobey legal orders, he said it's their duty to disobey ILLEGAL ORDERS, emphasis on illegal.

A highly decorated retired Navy Captain who quotes the U.C.M.J. is not and cannot be guilty of sedition. Anybody who has ever taken the oath upon joining the military knows that you do not have to follow unlawful orders. Captain Kelly clearly stated he was talking about unlawful orders. Only if you are guilty of issuing unlawful orders would you rant and threaten such a statement with a Court Martial. Hegseth is completely out of order. The person who should be called back into the military is, in fact, Sec. Kegsbreath.

that what Kelly said is absolutely the truth under article 92 of the Uniform Code of Military Justice. There is no ambiguity about this. Article 92 is clear that a soldier must obey legal orders, but not illegal orders. There can be some ambiguity about what is an illegal order. Much of the commentary and advice to soldiers refers to obviously illegal orders, and the murders in Venezuelan waters are recent examples of obviously illegal orders. Kelly and his cohort may have been warning more about any attempts by Trump to declare martial law and to authorize deadly force by the military against American citizens on American soil.

Not one fucking word about the real issue. I really, really hate MSNBC. They claim to be the honest broker in the news business, yet 99% of the time, they just repeat Trump's talking points verbatim.

Nor did they bother to mention that of the 6, Kelly is the only one that the Pentagon can harass because the other 5 discharged before qualifying for a pension and therefore have not been subject to UCMJ since the date of their discharge.

A sitting US senator cannot be recalled to the military .
First he would have to be expelled from the senate .
By a 2/3 majority .
