Democratic lawmakers reacted with ferocity and some Republicans with cheers to the Friday arrest of Wisconsin judge Hannah Dugan for allegedly helping an undocumented defendant avoid arrest by ICE agents.
Why it matters: To Democrats, the arrest marks a significant escalation in President Trump's efforts to consolidate power and use federal law enforcement to crush legal obstacles to his agenda.
"It is remarkable that the Administration would dare to start arresting state court judges," said House Judiciary Committee ranking member Jamie Raskin (D-Md.). "It's a whole new descent into government chaos."
"The Trump administration again is breaking norms in how it's dealing with immigration, the legal system, and normalcy. ... This is stuff I expect from Third World countries," Rep. Mark Pocan (D-Wisc.) told Axios.
Said Rep. Greg Landsman (D-Ohio): "They arrested a judge?! They can no longer claim to be a party of law and order. This will have to be a red line for congressional Republicans. Unbelievable."
What happened: Dugan was arrested Friday morning at the Milwaukee County Courthouse on charges of obstruction and concealing an individual, a spokesperson for the U.S. Marshals Service told the Milwaukee Journal Sentinel.
The Milwaukee County Circuit judge is in federal custody and was scheduled to appear before a U.S. magistrate later Friday.
A source familiar with the matter, speaking on the condition of anonymity, confirmed the arrest to Axios.
FBI Director Kash Patel, in a now-deleted post on X, accused Dugan of "intentionally misdirect[ing]" ICE agents who were attempting to arrest Eduardo Flores Ruiz, an undocumented defendant in her courtroom.
The other side: Rep. Derrick Van Orden (R-Wisc.) told Axios, "It is abundantly clear that many activist judges around the country have been acting politically in order to sabotage President Trump's agenda, and disenfranchise the 77 million Americans that voted for him."

may agree with her on the subject matter, I can't get behind this sort of thing. We can't have judges deciding which laws to uphold, that is the very thing that causes a breakdown of a working system, and it nullifies the power of the people we elect to write laws on our behalf. It is also a blatant violation of the oath that they take. This is a steep slope that we shouldn't be encouraging. The cure is in our elected representatives.

(2,616 posts)not Harriet Tubman, they are bound to follow the laws as written. Firstly, a warrant is not required in order to arrest someone. Regardless there was a valid and active immigration warrant issued for this guy. Also, rules may be pesky at times, but they have to be there for good reason. No one is above the law.
In addition, this guy was deported once already and snuck back in a second time. This is illegal.
At the time, this guy was in court for beating someone to a pulp over loud music, and the judge, knowing federal agents were in the building to collect him (on an active warrant), adjourned his court hearing without even telling the prosecutors so she could sneak him out of a side door and evade the federal agents.
This judge broke the law, and we simply can't promote that. That is, unless you think we will regain control of the country and keep it that way forever. We have laws for a reason, and we elect people to do that on our behalf. Judges don't get to decide that. Just because we may like the outcome, it's reckless and destructive to support and promote such actions.

(25,250 posts)First, state and municipal courts are not obligated to assist ICE. They are not part of the federal system.
Second, each jurisdiction in the country has its own laws regarding where ICE is permitted to pick up people for any immigration violations. Most of them forbid ICE from picking up immigrants inside a courtroom. The reason for that is that it can interfere with court actions in process, e.g. when the immigrant is testifying as a witness to a crime. Judges must be permitted to carry out their duties and the legal processes within their courts, without outside disruption and obstruction during a hearing or trial. So, it was ICE that was breaking the law, not the court justice.
Third, there are places within a courthouse building where ICE can pick up immigrants for detention -- OUTSIDE of the courtroom, e.g. in the hall, in another room of the courthouse, so long as they are not disrupting or obstructing the court's ability to carry out justice. So, for example, if an immigrant is waiting outside the courtroom to be called as the state's witness to a crime and ICE picks up him/her and removes them, the trial is jeopardized without the ability to get the witness' testimony. That puts the community at risk if it results in a criminal not being convicted.
Fourth, the justice in this case did NOT hide the immigrant from ICE. She showed him another door to exit from the courtroom into another room within the courthouse. The immigrant was picked up by ICE outside of the courtroom instead of inside of it, so there was no justification for arresting the justice.
The federal government is overriding the state and local court systems, thereby obstructing state and local laws. This is just practice to get Americans accustomed to people being picked up anywhere at any time for any reason -- without a hearing, representation, or notification of friends or relatives. The general public is being conditioned to think, "Oh, it's an illegal immigrant, so they don't have rights." But, in fact, according to the Constitution, they do have rights. They have the right to a hearing to have their case heard and the right to contact an attorney to represent them. There are groups of immigration attorneys, usually associate with churches, who will take pro bono cases to help immigrants navigate the legal system.
Once Americans get accustomed to the idea of "the other" being disappeared without notice or rights, the next move on this slippery slope is to target American citizens in the same way -- for political reasons, racial or ethnic reasons, or to silence members of the press.

(38,921 posts)He was in her court for pre-trial on the charges that they say were the reason for the arrest. Those were state charges that were in the trial process. Somebodys in trouble and it isn't the Judge.
Ice admits to be staking out the court.

(7,742 posts)The problem with Trump's agenda is that it doesn't follow the rule of law, so Judges uniformly around the country are opposed to it.
Rep. Derrick Van Orden, district 3 in Wisconsin, won by less than 12K votes in 2024.
I hope his praise for this despicable action sinks him in 2026.

We believe Judge Dugan intentionally misdirected federal agents away from the subject to be arrested in her courthouse, Eduardo Flores Ruiz, allowing the subject an illegal alien to evade arrest, he wrote in a missive that was deleted a short time later. Thankfully our agents chased down the perp on foot and hes been in custody since, but the Judges obstruction created increased danger to the public.
Democratic Sen. Tammy Baldwin of Wisconsin didnt quite see it that way.
In the United States, we have a system of checks and balances and separations of power for damn good reasons, the senator said in a statement. The presidents administration arresting a sitting judge is a gravely serious and drastic move, and it threatens to breach those very separations of power. Make no mistake, we do not have kings in this country, and we are a democracy governed by laws that everyone must abide by. By relentlessly attacking the judicial system, flouting court orders, and arresting a sitting judge, this president is putting those basic Democratic values that Wisconsinites hold dear on the line."

Through her legal counsel, Dugan issued a statement Friday afternoon that read, Judge Hannah C. Dugan has committed herself to the rule of law and the principles of due process for her entire career as a lawyer and a judge. She has retained former United States Attorney Steven Biskupic to represent her. Judge Dugan will defend herself vigorously and looks forward to being exonerated. This will be the extent of any statements or interviews at this time.

(162,428 posts)I am a corporate lawyer but I do know basic federal criminal procedure. Judge Dugan was arrested on a magistrate warrant and the case had NOT been presented to a grand jury. Before this case can go to trial, this case has to be presented to and voted on by a grand jury. The arrest on Friday was a stunt to "whip the MAGA faithful into a frenzy." One can arrest a suspect without a grand jury indictment but normally there has to be good reason for such arrest

Additionally, Dugan was arrested pursuant to a criminal complaint signed by a federal magistrate judge. Theres nothing improper about that as such, but for felonies in federal court, prosecutors must convene a grand jury and present evidence. Only if the grand jury returns an indictment can someone be prosecuted.
Going before a grand jury isnt a nicety or a minor procedural step. The Fifth Amendment requires it. Arresting Dugan before convening a grand jury was intended to get flashy headlines and whip the MAGA faithful into a frenzy. Even if a grand jury declines to indict Dugan, the administration has succeeded in creating a climate of fear and suspicion.
Recall that although Trump faced 88 charges in four criminal cases for much worse things than what Dugan is accused of, he was always charged by indictment after presentation to a grand jury and allowed to turn himself in. Here he is in Georgia, where he faced 13 felony counts for trying to overturn the 202 election. Here he is in New York, where he faced and was convicted of 34 felonies related to falsifying business records to hide his hush payments to Stormy Daniels. New York state was so solicitous of Trump that he didnt even have to have his mug shot taken. When he voluntarily surrendered in Miami for the classified documents case, he wasnt handcuffed.,,,,,

As much as the administration would like it to be otherwise, those administrative warrants arent the same as judicial warrants. Judicial warrants are signed by a federal or state judge or magistrate and must be complied with as long as they are valid. Administrative warrants also known as immigration warrants are issued by administrative agencies such as ICE and signed by an immigration judge. Despite also being called judges, immigration judges are not part of the judicial branch. They are appointed by the attorney general and are part of the executive branch.
I wonder if this case will ever be presented to a grand jury,
